If the energy density of space stays the same, but the universe is expanding, the implication is that energy is not conserved. Perhaps many assumptions about conservation are wrong - conservation of information, energy... Perhaps nothing need be conserved, if one is considering the scale of the whole universe. (And perhaps a black hold contains another universe.)
